Can I Fence Across a Storm Drainage Easement?
Why fences can't block drainage easements, and how to fence a yard with a swale.

Charlotte's UDO prohibits fences in storm drainage easements that impede or obstruct stormwater runoff. Many subdivision lots have swales or pipes in recorded drainage easements, often along rear or side lines. A fence there must let water flow freely, or be placed outside the easement.

Common situations
- Rear-lot swales in Steele Creek, Berewick and newer subdivisions
- Side-yard swales between houses
- Inlet boxes and pipes in back yards
Design options
- Keep the fence outside the easement
- Use open fence styles where allowed
- Leave the swale bottom clear
- Add a gate for maintenance access
Why it matters
Blocked swales cause ponding, erosion and water in crawlspaces, sometimes for neighbors upstream. Easements also let the city or HOA maintain drainage.

Builder swales
Many newer Charlotte subdivisions are graded with shallow swales that carry runoff from several lots. They’re often in drainage easements along rear or side lines. Blocking them can cause water to back up into neighbors’ yards.
What to look for
- A shallow ditch or low path in the yard
- Inlet boxes or grates
- Pipes emerging from the ground
- Easement labels on your plat
Gates for access
If a fence must cross an easement where allowed, a gate or removable panel lets crews maintain drainage.
Questions Charlotte homeowners ask
How do I know if I have a drainage easement?
Check your recorded plat. Drainage easements are usually labeled with dimensions.
Can I put a gap under my fence?
A raised fence or open style can help water pass, but a fence still can’t obstruct the drainage way. Ask before building in an easement.
