Stream Buffers (SWIM) and Fences
What Charlotte's stream buffers protect and how they affect fences on creek lots.

Charlotte protects many streams with buffers under the Surface Water Improvement and Management (SWIM) program and UDO Article 26. Buffers limit disturbance near streams, and fences or clearing within a buffer may be restricted or require approval. Before fencing a creek lot, check whether a buffer applies and where its edge is.

Why buffers exist
Natural stream banks with trees and shrubs filter runoff, cool water, reduce erosion and give wildlife a corridor. Charlotte’s streams flow to the Catawba River and its lakes.
Fencing on a creek lot
- Keep the fence out of the buffer unless allowed
- Avoid clearing vegetation for a fence line
- Choose open fences that don’t trap debris
- Never block drainage paths
- Expect floodplain mapping near larger streams
Other water rules
- Floodplain: see Floodplains and fences
- Post-construction stormwater rules (UDO Article 25) on newer developments
- Water supply watersheds (UDO Article 23) near drinking water lakes like Mountain Island
Buffer zones
Stream buffers typically include zones closest to the stream with the most protection and outer zones with more allowed uses. Exact widths depend on the stream and rules.
Approvals
Disturbance in a buffer may need approval from the city or county. Ask before building.
Good practices
Keep vegetation intact, use open fences and avoid storing materials near streams.
